No progress. Project still under SWO. Emailed Debbie Spoja to notify that further enforcement may be neccessary if the project starts to erode onto the adjacent lots and that the project is still subject to compliance with the erosion permit despite it being temporarily on hold.

Developer's investigation found that the majority of the runoff was entering the project area from the farmers irrigation ditch and not from the north section of Warm Springs Creek. Developer and contractor made efforts to reinstate the historical flow of the agricultural ditch (with landowners approval) and has diverted flow away from construction. This diversion ditch and dam shall be included in SWPPP inspections to ensure it is functioning properly. Runoff from Warm Springs Creek entering the site from the north side shall be monitored during SWPPP inspections and during the next runoff event to ensure water continues to be adequately diverted and that the one foot of freeboard at the discharge point is maintained at all times. If it is found that runoff is entering the project from Warm Springs Creek, Contractor and developer must be ready to implement a contingency plan to divert this water to the farmers irrigation canal or other approved method. In order to be ready to act on the contingency plan, other permitting agencies.may need to be notified
2. The total permitted area for ESC12-00539 includes 13 acres for Harris Ranch Phases 8 and 9 and an additional three acres for the Warm Springs Creek Widening Project. The material staging area for equipment and stockpiling was not on the approved plan. Please calculate the total disturbance area for the permit and amend your plan accordingly. You will also need to update your ESC permit with the additional disturbance. The permit fee for each additional acre of disturbance is $52.50. Once we square up on this, we can lift the stop work order.
