***APPEAL REC'D 4-11-2019*** We plan to change the property use from office space (formerly chiropractic and law offices) to a child care facility for up to 40 children from infant to preschool age. The interior of the building will not undergo any structural changes; the exterior may gain a low (3-foot) fence and gate in the future, once given approval by the ACHD through their License Agreement process.

In order to meet City parking requirements for off-street spaces, office space such as the two prior tenants are required to have 7 spaces available for a 2,027-sqf space. Our use requires only 4 spots, so continuing to allow a parking reduction for our new use will have even less of an impact on the surrounding area's parking than previous occupants. Le Soleil has done parking studies at peak times on three days of the week, with photographic evidence of available parking and of traffic flows which support the idea that even at drop-off and pickup times (which will vary throughout the day depending on family needs), nearby parking will continue to be available to residents and other businesses on the block. A previous occupant and current owner, Klena and Associates, PA, had up to 11 staff members on site at a given time according to owner Tim Klena, with upwards of 20 clients parking within an hour during business hours. Our use at capacity will have a lower impact on both parking and street traffic than this previous use.A detailed explanation is available in the Letter of Explanation.
