(BAD BOYS BURGERS) A new tenant within an existing building of 1,720 sq. ft. first floor area consisting of a kitchen / preparation area of 788 s.f.; a 622 s.f. Dining Area W/ 10 (4) seat & 1(6) FIXED seat booths and tables & chairs; a 227 s.f. Restrooms / Storage/ Service Area; a 300 sq. ft. basement area for use as office / mechanical occupancy; and the remainder a 1,420 sq. ft. crawl space. The crawl space area is to be separated from 300 sq. ft. usable space of basement with 1-hour construction on room side of walls & ceiling, with 18" by 24" crawl space access panel as the only opening between the two areas per plans & section 712, 1997 UBC. Crawl space portion is not to be used for other than existing mechanical /electrical service (NO STORAGE , OFFICE OR OTHER USE ALLOWED UNDER THIS PERMIT). Scope of Work: To construct approximately 8-1/2 ft. by room height wall of 2" x 4" stud framing W/ 5/8" sheetrock cover, texture & paint, to divide portion of existing kitchen; to install three new sinks, based on previous plans on file; install new floor drains & plumbing lines to serve the restrooms with connection to exisitng sewer drain lines; to install ceramic tile veneer finish at interior perimeter walls by windows; paint walls, repair ceilings & flooring, new finish for booths; framing and 1-hour construction for 300 sq. ft. room in basement per plans; and to provide secure cover over North side exterior stairwell to prevent use or access to basement by other than repair service persons; to remove all debris from basement to "broom clean condition". NOTE: Future expansion of usable basement area beyond the 300 sq. ft. bounds established by this permit scope, first requires submittal of building permit application; plans (2 copies) by an Idaho licensed architect, submitted for review and approval for issuance of a building permit, to bring the basement exiting system, sprinkler system (sec. 904.2.2), and items specific to occupancy use group proposed, all per current adopted codes & ordinances in force at time of submittal & review. Plan Reviewer's activity  11/30/2000  
Previous meeting with proposed tenant, Alex Paflias, resulted in a review of the History of the existing facility for past code compliance and an existing Certificate of Occupoancy which moght be transferred into the new tenant 's name - BAD BOYS BURGERS". Ther was no C.O. found and the previous tenant/owner, Taco John, had performed work and occupied portions of the basement W/O having met the requirements of plans & application and the conditions for complying second exit from basement and the need to provide a fire sprinkler system throughout the basement. These deficiencies had been noted with Taco John managers / owners on three different occasions starting in 1991 when a correction notice was issued to the manager after a site inspection was performed as a result of the owner obtaining an occupancy approval review permit that allowed the building department to perform an inspection to determine code upgrade requirements, if any, that needed correction before a certificate of occupancy could be issued. This permit was expired per section 303 (D) of the 1988 UBC. In 1993, another permit was applied for an issued to determine requirements for issuance of a certificate of occupancy. A correction notice was again issued and this resulted in the tenant owner applying for and recieving a permit to reduce the size of the basement usable space to 300 sq. ft. or less per section 3303(a), exception #5, 1991 UBC. This allowed the existing 1- exit from the basement and the remainder to be considered as non-habitable, non-usable crawl space. There were no further calls for inspections or completion of the permitted work. After the 180 days without calls for inspection the permits, per code, expire.
The visit with Mr. Paflias, resulted in the need for obtaining an architect to review the site for code compliance and the proposed tenant / owner and architect determining the course of action they desired to take and submitting plans and application for a permit to perform the work required. This involves the finish of a basement area of 300 sq. ft for tenant use.; the cleaning of the remaining area to 'broom clean' to be known as a crawl space (no occupancy or use); new sink installations; two new floor drains for existing restrooms and a new 8 ft. section of framed, finished wall in the kitchen, per the plans presented on 11/30 00 by Alex Paflias as drawn by Billy Ray Strite, Architect.

Call to Bill Strite to request the submittal of the application for the permit to accompany plans received earlier in the day from Alex Paflina, new tenant. Alex had stated he had given the application and a letter stating his understanding that the use of the basement are would be limited to a 300 sq. ft. or less room area and he agrees to abide by this understanding and to see his staff also abides by the requirements. Further use of the basement can only occur after architecturally prepared plans (Idaho license), application and details showing how the basement would be brought into code compliance with exits, sprinkler system and occupancy requirements per current adopted codes in force at time of submittal.
