Approved per CUP01-00163 and as per W. Gibbs email dated 12/11/2003 indicating that the plan was of necessity revised to show the new ROW which
include placing the planter strip and sidewalk in the ROW. Since
ACHD did not require additional ROW from the property to the
east, there is a 5-foot jog in the sidewalk. We should not require a CUP mod. because ACHD took additional ROW and the final plat was approved and recorded showing that additional ROW.
