APPLICANT CERTIFIES EXEMPTION PER IDAHO STATUE 54-5205) (MAIN STREET BISTRO, HOOKA BAR, OFFICE & SALES/DISPLAY- 2ND FLR REMODEL) **AS-BUILT PLAN MODIFICATION2/20/07. THREE AREAS ORIGINALLY LABELED AS PRIVATE SMOKING ROOMS WERE CHANGED TO BE A BAR, STORAGE & OFFICE. tHE SIZE OF THE SALES AREA WAS REDUCED TO ALLOW 10 SEATS FOR SMOKING GROUPS. THE TOTAL OCCUPANT LOAD OF THE SECOND FLOOR WAS REDUCED BY 10.** THE ATTACHED PLAN REVIEW CONDITIONS REMAIN THE SAME AS ORIGINAL. This building is fully sprinklered. To modify the use of the second floor, (approved plans on file for use as dining area for Louie's Restaurant in 1985, fiche #952884) for an assembly occupancy use Hooka Bar, Retail Sales/Display & Office expansion. To modify the 4,462 sq. ft. second floor of the existing 11, 388 sq., 2 story, Main Street Bistro, and a 2,172 sq. ft. storage basement. The north end of the 2nd floor will be for office use. Work includes 3/4 hour fire assembly protection of openings onto existing fire escape that will serve as one of the required exits (Sec. 3404 IBC); to provide a new exhaust energy recovery mechanical unit in place of existing roof unit to meet special exhaust needs of a smoking lounge per 2003 IMC, and associated ductwork; to add new handrails at existing interior stairs per plan; to modify restroom doors to improve accessibility; change out door hardware as needed to meet exiting requirements from all areas and modify fire escape system as needed to comply with most restrictive requirements of Sec. 402.5, 1994 UCBC & Sec. 3404, 2003 IBC. To post a maximum floor load sign of 65 PSF for Floor Area #2 & 100 PSF for Floor Area #2 (based on engineering) and post a maximum occupant load of "58" in the Hooka Bar, based on booth seating for the 2nd floor assembly use. NO MOVABLE SEATING IS ALLOWED BASED ON DESIGN FLOOR LOAD. A new Certificate of Occupancy is required for Main Street Bistro, Hooka Bar, Sales/Display & Office Uses. Call from Mr. Mayer. Said he new nothing about the main street Bistro. Bud was downtown before and probaly had a file. Said the CDH does not monitor or license bars (as long as no food is served.) Bob said he would need to see a plan and make notes of what has been added for a file for reference in case a complaint was ever filed, they would have record of business activities approved.

After site visit of 2/16/07 with contractor, inspector and architect, several changes to the original approved plans were observed at the job site. Architect told to resubmit plan modifications with analysis of effect of changes on original reviewed plans. An additional office, storage area and new bar service station were provided in locations of private booths on original plans and the booths were relocated to the original sales area reducing the sales display area. The exit to the fire escape from the private room areas is not an exit as it is now in the private office. Need exit sign directing patrons to remaining exit door to fire escape. The restrooms of the second floor were to have doors modified to provide improved accessibility. The actual layout of the restroom doors in relation to the required landing at the top of the existing stairs, so as not to impede the use of stairs as exit, has been deleted from project. Accessible facilities are available on the main floor.

CENTRAL DISTRICT HEALTH. Plans did not indicate the required sign off by CDH so as an e-mail was sent in by Bob Mayer (CDH Health Inspector) with the following comments:
As per our conversation this morning, Central District Health Department has Main Street Bistro assigned a Low Risk Category. This was done by Carol Johnson from our office: Plan Review with architect, John Price (3/19/02) for removal of kitchen and addition of new bar; and (3/13/03) sign-off of Building Permit for wall change in old dining room and removal of old employee restroom. Aside from this no other plans have been seen at our office for this project. the Idaho Food Code does not require licensure/inspection of establishments assigned to a low risk category, either because only packaged foods are served, or because no food is served.
