A new CofO will be issued upon completion of TI for BodyBuilding.com. The building is fully fire sprinklered for area increase and has existing storage racking in the warehouse area of this tenant. Per: discussion w/ Bruce Chatterton, Jenifer Gilliland, and Teresa Sobotka we will consider easement outlined on ROS-5567 as public way due to Recorded Easement Documentation (100030011) and that documentation stateing that the easement cannot be terminated unless ACHD agrees. Building area was determined by using Section 506.2 and the exception allowing W to by less than or equal to two.

Repair the two exit sign/emergency lights as marked on the plans. Provide the three new emergency lights as marked on the plans. Provide a racking permit for all of the racks that are currently being installed. The extended coverage upright heads located on both sides of the two hour demising wall are obstructed by the enveloped trusses. This work requires a separate sprinkler permit. Repair the roll down fire doors in the two hour demising wall or get permision to lock them shut from the Boise Fire Dept.

The easement cannot be terminated without ACHD approval & sign off. The easement transfers with the property. Took this information to Bruce Chatterton & Jenifer Gilliland to share. Agreement to accept recorded easement for use of building code for area increase.

Meeting with Bruce Chatterton & Jenifer Gilliland to discuss information Teresa Sabotka had provided concerning the recorded easement and the inclusion of ACHD in the easement which would require ACHD approval before the easement could be vacated. This building with area separation walls does not appear to have been constructed per approved plans issued by Ada County under the 1997 UBC for the occupancy use's indicated. Boise City annexed the property and a copy of the original approved plans and a copy of the Certificate of Occupancy for Hayden Beverage who occupied the entire 82,000 sq. ft. plus building in Ada County. A 2-hour area separation wall was created to allow review of the building as two stand alone buildings. One building appears to be within allowable area and one portion non-conforming under the 1997UBC. Under the cirrent 2003 IBC, using Section 506.2.1 of the 2003 IBC, Exception, for buildings that would qualify for unlimited area per Section 507, in this case the existing 'B & S" occupancies qualify as occupancy use type and are fully sprinklered but lack the 60' all around. The exception allows that the value of "W" divided by 30 not to exceed 2 in the frontage increase formula. The value of "W" is determined by use of a weighted average of distance of building to property line of 20' minimum upto a width of 60' and obtaining an average to multiply by the length of wall between 20' to 60'. This is repeated for each portion of wall to create an average for that portion of wall 20' or greater but less than or equal to 60'.
A copy of a recorded easement was provided for this property and evaluated by our legal department. ACHD had required the easement and were a third party to the easement. ACHD would need to approve the vacation or modification of the easement as well as property owners. This would be the same as having Boise City as a third party participant in a recorded easement. This recorded easement document was accepted based on legal review and discussion with Bruce Chatterton, PDS Director and Jenifer Gilliland, Building Division Manager. Evaluating the tenant space as a stand alone building under the 2003 IBC and the existing 2-hour area separation wall, the set back, per the UBC & IBC can now be taken to the center line of the right-of-way (easement). This value, when used with the exception for determining the value of "W" for the frontage increase formula, indicates the building (tenant space) to be within allowable area limits.
