KABUL MARKET - Remodel and Expansion. ***5-4-2012 PLAN MODIFICATION TO INCLUDE: REMOVE COMMERCIAL KITCHEN COOKLINE FROM PROJECT.** NOTE: An Upgrade Agreement (attached to this case) exists on this building to upgrade the south exterior wall at a future date. Remodel of existing 2,301 sq. ft. Kubal Market for use as a 1,706 sq. ft. fast food restaurant with dining, kitchen & prep areas and expansion into adjoining 1,394 sq. ft. fire damaged previous Hooka Bar space for the 1,989 sq. ft. retail sales / display area, creating a 3,695 sq. ft. Kabul Market / Fast Food tenant space. Partial permit allowing select scope of work is being done under BLD11-01514. Work to include: Demolition work per plans; construction of interior non-bearing partitions walls to create; a new dining area, commercial kitchen area, two new fully accessible male and female restrooms, storage room, and mechanical room; install a new walk-in freezer; install new commercial kitchen fixtures including a new (type I) commercial kitchen exhaust hood and duct system, a new point of sale customer cashier counter; new interior and exterior lighting; electrical, mechanical and plumbing work; interior finishes in compliance with chapter 8 of the 2009 IBC; and all other work per the approved plans, attached plan review report, and all applicable codes. A new Certificate of Occupancy with the new occupant load total is required to be obtained after all work has been inspected and approved and prior to tenant occupying this space. Has a non-build easement on the adjacent property been obtained? Has the roof structure over the property line been removed? Please provide an immediate response with a status.

Meeting with the applicant, the design proffessional, building official, planner, and myself. This meeting was requested by the design proffessional to discuss the plan review corrections. More specifically: the change of use, exterior upgrades to an existing exterior wall located on the property line that is not in compliance, and changes to the exterior windows that modify his zoning approvals. The applicant and his design proffessional do not agree that a change of use has occured, do not want to correct the property line wall issue, and want to remove some windows that were required per planning and zoning approvals. Jason Blais the Building Official offered a Temporary Occupancy permit once permit is issued without the exterior wall corrections being fully completed to help. SRZ
