Finaled per direction from legal and Building Division Manager. Looking into State Law Title 39 Chapter 41 Section 39-4111 (3) where a substantial safety hazard has to be determined within the existing building and created by the alteration or addition in order to require upgrades to the unaffected existing portion of the building. Association of Idaho Cities (AIC) attorney also contacted for clarification/interpretation of this changed statute language. Many jurisdictions are unclear or at odds with this statute language and the requirements of the International Residential Code for upgrading existing homes with smoke alarms and carbon monoxide alarms. Further research and discussion is needed with various groups on this issue.
