This application is for the permit modification of ESC 12-00539. The permit modification application to ESC 12-00539 failed for the following reasons. 1) Need submittal of the sections of the SWPPP that have been revised. This includes but is not limited to a description of new BMPs that will be required for this additional scope, methods that will be used to perform work in the dry and/or a dewatering plan, new discharge location(s), ect. 2) Drawing showing any drainage easements (Boise does not have jurisdiction of wiork performed on canals, ditches and other water conveyance facilities which occur within the fee title lands, ROW or easements for such facilities), location of BMPs in the area of new disturbance, and BMP installation details not otherwise listed. Other items to note: The EPA permit number referenced in the applicant's cover letter IDR10CO46 is not associated with this project. The EPA permit number referenced in the cover letter IDR10CR48 indicates coverage under the 2008 CGP (expired) and not the 2012 CGP. No plan modification has been applied for with the EPA for this additional scope of work. Lastly, Warm Springs Creek appears to meet the definition of Waters of the U.S. because a direct link exists to the Boise River.
