this is the replacement of an exisitng wall that was failing. there was and is a new fecne that is offset from the wall. this is considered maintenance due to the failure. there is a recorded easement attached to this permit allowing work to be done on properties.

the wall is for a replacement wall that crosses the common side property line. it is presumed that the adjacent owner does not know that work is being done on their property. both parties need to agree to allow work and both parties should have an easement agreement. it would appear that a metes and bounds moved the property lines and then a ROS (7905) was recorded to delienate said M&B.
